What is a serious injury claim?
A serious injury claim is a personal injury claim where the injury has had a significant effect on the injured person’s life. This may include long-term symptoms, time off work, ongoing treatment, permanent scarring, psychological symptoms, reduced mobility, care needs or difficulty returning to normal activities.

Examples of serious injuries
Serious injury claims may involve fractures, head injuries, brain injuries, spinal injuries, serious soft tissue injuries, scarring, burns, psychological injury, injuries requiring surgery, long-term pain, or injuries which affect work and daily life.
The seriousness of a claim is not always obvious at the start. Some injuries develop over time or continue longer than expected, so proper medical evidence is important.
What can be included in a serious injury claim?
A claim may include compensation for pain, suffering and loss of amenity, together with financial losses caused by the accident.
Financial losses may include loss of earnings, treatment costs, rehabilitation, care and assistance provided by family or friends, travel expenses, medication, damaged property, adaptations, future losses and other expenses linked to the injury.
Medical evidence, treatment and rehabilitation
Serious injury claims usually require careful medical evidence. This may involve medical records, GP or hospital records, and reports from independent medical experts.
In some cases, rehabilitation, physiotherapy, counselling, pain management or other treatment may need to be considered. We can explain what evidence may be needed and how treatment-related losses may be approached.
What evidence may help?
Useful evidence can include photographs, witness details, accident reports, medical records, hospital letters, treatment invoices, wage slips, employment records, receipts, care notes, travel expenses and details of how the injury has affected daily life.

Claims involving children or protected parties
If a serious injury claim involves a child, or an adult who lacks capacity to conduct the claim themselves, additional safeguards may apply. A suitable adult may need to act on their behalf, and any settlement may require court approval.
Where we act for a child in a personal injury claim, we do not deduct a success fee from the child’s compensation. The child keeps 100% of the damages awarded.
